These Special Conditions are issued under and in addition to the Belmond Group– Goods Purchase Order Form – General Terms & Conditions (“General Terms”).  Terms defined in the General Terms shall, unless otherwise defined, bear the same meaning in these Special Conditions.

1. Applicability 

These Special Conditions apply to any Purchase Order which includes:

a. window treatment fabrication and/or soft furnishing manufacture (“Soft Furnishings”);

b. lighting; and/or

c. loose furniture. 

2. Shop Drawings and Samples

2.1 Within 5 Business Days of the date of this Contract, the Supplier shall (at its cost) deliver to the Buyer’s Representative:

a. detailed shop drawings for the Soft Furnishings, which shall be in the following ranges of scale 1:10, 1:5 and 1:1, reproduced on white paper; and

b. samples of all equipment, materials, finishes (at least three (3) copies and/or sets).

2.2 The Buyer shall give comments on or its approval of the shop drawings and samples within 8 (eight) Business Days of receipt (“Review Period”), Supplier must obtain confirmation from Buyer before proceeding.  If the Buyer requests any changes to the shop drawings and/or samples within the Review Period, the Supplier shall make such changes and re-submit them for approval in accordance with clause 2.1 and this clause 2.2 until the Buyer approves or is deemed to approve them, at which they shall become “Approved Drawings and Materials”.

3. Warranties

3.1 In respect of Soft Furnishings, the Supplier warrants that: 

a. all Soft Furnishings (and their components) shall be new and of first quality and shall conform to the Approved Drawings and Materials;

b. all foam and textiles used shall be flame retardant to the relevant British Standard(s);

c. all exterior foam shall also be Urecel Quick Dry Foam (or equivalent satisfactory to the Buyer’s Representative;

d. unless otherwise requested by the Buyer’s Representative, all loose cushions shall be filled with Comforel (or equivalent satisfactory to the Buyer’s Representative);

e. all cushion zips to be concealed, non-rusting and with colour matching face fabric.

3.2 In respect of lighting, the Supplier warrants that:

a. all lighting will meet British safety standards and applicable international codes & standards; 

b. cords are to be black in colour a minimum of 2 meters long and shall be double insulated and grounded, unless otherwise stated on the specification or costing schedule;

c. lamp bases are to be weighted to ensure stability;

d. all lamps are to be supplied with LED bulbs Philips or Osram, unless otherwise stated on the specification or costing schedule;

e. lamp shade fabric shall be installed so as to avoid bubbles or wrinkles;

f. lampshade frames shall be galvanised and powder coated;

g. if the Buyer wishes acrylic diffusers to be fitted to the lamps, the Supplier shall fit them so they remain horizontal and do not create a shadow on the lampshade;

3.3 In respect of loose furniture, the Supplier warrants that:

a. all interior foam/cushion is to be as per Buyer’s written specification; all interior foam is to be flame retardant, to British Standards (Supplier to provide applicable certificate(s));

b. all exterior foam is to be Urecel Quick Dry Foam (or equivalent satisfactory to the Buyer’s Representative);

c. all drawer runners to be Hafele concealed full extension soft closing runners or equivalent satisfactory to the Buyer’s Representative;

d. all hinges to be Hafele soft closing or equivalent satisfactory to the Buyer’s Representative;

e. all interior upholstery and loose cushions to comply with the Soft Furnishings warranties set in 3.1 above;

f. all outdoor upholstered furniture to have drainage mesh concealed on the underside of the cushion;

g. all hardwood to be Grade A and uniformly Kiln-dried, treated and to be insect and vermin free;

h. all hardware and metal work to be rust proof & corrosion free;

i. all loose furniture glides to be Magiglide or equivalent satisfactory to the Buyer’s Representative and fixed by nail/screw;

j. all loose furniture will be stable;

k. no loose furniture will feature any manufacturer name/logo;

l. mirror glass will be supplied with safety backing film.
